Lindsay Lohan's July 2007 DUI bust came back to haunt her last week, with three men filing an assault and battery lawsuit claiming that an intoxicated and agitated Lohan jumped behind the wheel of their SUV and took them on a not-so-joyful ride as she pursued her assistant along Malibu's Pacific Coast Highway following a private party.
"Each of them felt surprise, shock, fear and panic at Lohan's surprising and sudden act of taking [coplaintiff Dante Nigro's] vehicle to begin to chase after Taryn," whose boyfriend Dan was driving Nigro's 2004 Yukon Denali that night, state court documents filed Oct. 14 in Los Angeles Superior Court.
Lohan was ultimately collared in the wee hours of July 24, 2007 in the parking lot of the Santa Monica Police Department on suspicion of DUI and cocaine possession. She later pleaded no contest to related charges and entered rehab for a third time.
But back to the other people involved…
Per the suit, fellow plaintiffs Ronnie Blake and Jakon Sutter were in the backseat of the Yukon and Nigre had settled into the front passenger seat when Lohan left the party after arguing with Taryn. Dan had walked over to Taryn, who was getting into her car, when Lohan spied the empty driver's seat and hopped inside.
"As it became clear what Lohan intended, the startled and fearful passengers cried for their lives," the suit states.
At one point, Blake grabbed his cell phone and got out of the SUV, after which Lohan accelerated and ran over his foot, "causing extreme pain and physical injury."
According to the suit, despite Nigre and Sutter's entreaties, Lohan refused to stop, responding "with hostile wrath" and threatening to sue when Nigre tried to grab the steering wheel. "She also stated that because she was a celebrity she could do anything she wanted," the suit says.
The complaint states that Lohan "drove at speeds over 60 miles per hour, and sped through intersections controlled by red lights and stop signs without slowing down" and, at several points, "came very close to colliding with other vehicles." Nigre and Sutter gripped safety bars on the SUV's doors and front seats to "avoid even more violent, jarring, jostling, and whipping body movement, and for balance against the extreme physical forces generated by the high speeds."
When the ride finally ended outside the police station, the plaintiffs say that they heard Lohan telling an officer that "the black guy" was driving, meaning Sutter. She was arrested and taken into custody after failing a field sobriety test.
Blake, Sutter and Nigre are seeking at least $50,000 in damages to cover negligence, assault, battery, false imprisonment, intentional infliction of emotional distress, conversion, trespass and slander.
In response to the complaint, an attorney for Lohan told E! News that he wondered why all of the men didn't just get out of the car, considering the starlet stopped more than once.
"If this was truly the 'worst night' of their summer, and not their best night, one has to wonder why they didn't just get out of the car during the many opportunities they had to do so," lawyer Ed McPherson said.
