Hoax Alert: Kevin Federline's Brother Reportedly Didn't File Claim Alleging He Fathered One of Britney Spears' Kids

Florida judges has dismissed TRO petition containing allegations that Christopher Federline fathered pop star's son Sean Preston

UPDATE: Where's Britney's BS Alert when you need it? The Smoking Gun is reporting that Christopher Federline never filed a lawsuit against his former sister-in-law and that the whole to-do is a hoax perpetrated by an ex-convict who was recently arrested for violating his probation on a conspiracy and wire fraud conviction.

Perhaps Kevin Federline ought to have a heart-to-heart with his brother, Christopher. Especially after the latter is now alleging he fathered Federline's eldest son, Sean Preston, with his ex, Britney Spears.

Federline's older sibling filed a one-page petition on Dec. 18 in a U.S. District Court in Tampa, Fla., seeking an injunction and temporary restraining order against Spears.

The reason?

Christopher claimed the "Toxic" singer stole his Capital One credit card to purchase $4,569 worth of comic books for Sean and her other son, Jayden James, when she went to Kevin's Florida house in early December to pick up the boys. Federline claims that when he confronted pop star about it, she allegedly told him Kevin had "ruined her life." He then asserted The X Factor judge made fun of him, and threatened blackmail by exposing him as Sean's true father if he reported the theft to police.

However, Christopher outed himself in court documents.

"I'm the true father of Sean Preston, not Kevin," he stated in his request. "I do confess I slept with Britney, and I am the true father, but the public does not need to know. I seek a restraining order from Britney Spears. She is out of control and a maniac."

Unfortunately for Federline, a Judge Steven D. Merryday two days later dismissed the petition with prejudice, meaning he's forbidden from bringing his case again. In his ruling, the judge cited as precedent Romano v. Kardashian, a previous filing by Gino Romano whose request for a TRO that included outrageous claims against Kim, Khloé, Kourtney and Lamar Odom was tossed.

Oops indeed.

No word whether Britney's contemplating a defamation lawsuit. Reps for Spears' camp and her ex-hubby Kevin Federline were unavailable for comment.
