Jason Luis Rivera set to be sentenced Friday; he was arrested in September and claimed to be Miley's husband

Don't mess with Miley Cyrus!

Jason Luis Rivera, the 40-year-old man who hopped the fence of Miley's home and proceeded to wield scissors around her yard last month, was convicted yesterday of both misdemeanor trespassing and resisting arrest.

The incident took place on Sept. 8, when Rivera was arrested at Miley's home after making his way onto her property and claiming to be her husband. The 19-year-old starlet was fortunately not home at the time, though someone else was, and that person phoned police.

Rivera pleaded not guilty to the charges last month. "I would say delusional is a good characterization of him," Lt. Brian Wendling told E! News after Rivera's arrest.

He has been in jail since his September arrest with bail set at $100,000. Rivera is set to be sentenced later today.
