Apparently the only place Michael Lohan can catch kids Ali and Cody these days is while watching E!'s Living Lohan.

Speaking exclusively to E! News, the family patriarch says he is taking ex-wife Dina to court this week in a sequel to their bitter custody battle.

"I didn't want to do it, but I had to. She left me no choice," says Michael. "She's missed 19 out of 31 appointments I had with my kids. Now, I'm giving her one last chance to let me see them one day a week, on my own, and to go to therapy with them one day a week. If not, we'll drag this through court again."

Dina's rep did not immediately respond to calls seeking comment.

Per a custody agreement hammered out last year, Dina has primary physical custody of Ali, 14, and Cody, 11; Michael has visitation rights.

"All I want is for her to live up to what she agreed to and stop missing our meetings. When the time comes, she always has an excuse, and I am tired of it. I won't put up with it any more. My kids haven't even seen my family in too long."

To that end, he has requested a hearing in family court in Long Island and is threatening to ask for a court-ordered drug test for his former missus.

Both of the battling Lohans are expected to be there.

Michael claims that since Dina got her deal with E! for Living Lohan, "she's become a diva again." (E! Online is a division of E! Entertainment Television.)

"Before the show, she didn't have anything going, had no money. I paid my kids' school tuition. And everything was fine, she was cooperating then. Then she got her show and, all over, she blew everything off. I won't let her do it any more."

As for family torch-bearer Lindsay, this is one controversy she's happily not involved in.
