A Brooklyn judge has dismissed a contempt of court charge against the Brooklyn Don Diva for allegedly violating a restraining order when she mooned her neighbor last summer. The case came to a halt after dismayed prosecutors revealed the purported victim refused to testify against the rapper.
The 32-year-old Brown, real name Inga Marchand, was busted last July for violating an order of protection taken out against her by Arlene Raymond, whom Foxy was accused of hitting with a Blackberry back in 2007 as part of an ongoing feud between the two.
In the latest run-in, Raymond accused the rapper of not only antagonizing and shouting obscenities at her when the two crossed paths in their Prospect Heights neighborhood, but also of bending over and flashing her brown-pantied booty while screaming, "Kiss my ass."
Brown maintained her innocence throughout, and with Raymond's last-minute refusal to cooperate with prosecutors, the misdemeanor contempt of court charge was dropped.
"The victim didn't want to testify," a spokesman for the Brooklyn district attorney's office tells E! News. "When Brown was arrested, we didn't have any indication that [Raymond] wasn't going to testify, so I'm not sure when this decision came about."
A trial date had not yet been set, but if the Ill Na Na purveyor had been convicted, she could have faced up to a year in jail.
An attorney for Raymond was unavailable for comment; however, she told the New York Daily News by phone that she refused to testify because, "The case was getting in the way of my personal life" and had become "a headache."
After today's hearing, Brown's attorney, Salvatore Strazzullo, told reporters that if the case had gone before a jury, he would have easily disproved the allegation. And how exactly would he have done that? By revealing that his client wasn't wearing undies during the mooning, which in his view, would have buttressed his client's innocence.
