"NYPD Blue" star, ex-girlfriend reach preliminary agreement in herpes lawsuit

There's a settlement in the air for Esai Morales and his ex-girlfriend.

Attorneys for both halves of the warring couple told a judge Tuesday that they have reached a preliminary agreement to settle a lawsuit brought against Morales by his former live-in girlfriend, Elizabeth Mazzocchi, who alleged that he abused her and gave her herpes.

Following Tuesday's court session, Los Angeles Superior Court Judge Robert L. Hess issued a minute order stating that while the case is "tentatively settled," an April 9 court date remains on the docket.

Neither Morales' attorney, Thomas A. Burgos III, nor Mazzocchi's attorney, Jason Beckerman, had any comment on the potential resolution.

Mazzocchi filed suit against Morales last July, alleging that he knowingly passed on an STD and assaulted her on several occasions during their relationship, including a forcible rape in May 2006.

In the aftermath of the relationship she was left with "an incurable disease that will have associated medical expenses, pain and discomfort for the rest of her life," according to her court documents.

She also alleged breech of oral contract, claiming the actor owes her $25,000 for management services.

Morales responded to Mazzocchi's claims on his MySpace page in July, calling her allegations "absolutely false and without merit."

"You know me. You’ve known me for nearly three decades. And you know in your hearts that these claims are baseless. This is not the way I live my life and I am incapable of committing these kinds of acts," he wrote, addressing his fans.

Prosecutors apparently believed him and cleared him last month of any criminal charges stemming from Mazzocchi's allegations.

Morales, who starred as Lieutenant Tony Rodriguez in NYPD Blue from 2001 to 2004, most recently appeared on CBS' resurrected series Jericho, which airs its final episode Tuesday.
