He wasn't naughty or nice. Sandra Bullock's reality TV star hubby was just plain on the losing side of a court ruling.

Jesse James will not be celebrating Christmas with 5-year-old daughter Sunny after an Orange County court ruled in favor of his ex-wife, adult film star Janine Lindemulder, in the latest round of their bruising custody battle.

Per the Los Angeles Times, the titular star of Jesse James Is a Dead Man turned up sans Bullock to watch his lawyer spar with Lindemulder, who was representing herself.

But although James, 40, had been awarded custody while Lindemulder spent six months in prison earlier this year for tax evasion—and despite Lindemulder operating an X-rated webcam out of her Hollywood home, Commissioner Thomas Schulte was apparently moved by the holiday spirit and decided to cut the Blink-182 video vixen some slack.

He ruled that she can spend Christmas Eve with Sunny as long as the girl's back with James by noon the next day.

Separately, though, he denied her request to expand her weekly daytime visits to overnight stays.

James, who's been raising Sunny with Bullock since January, was obviously pained by the ruling and refused to speak to reporters afterward.
