Charlie Sheen's ex, Brooke Mueller is heading back to court. But this time, she's the one taking legal action.

Mueller is suing The Canyon at Peace Park, a rehab facility in Malibu, for allegedly leaking information about her stay there in February 2010 to the media.

She filed her complaint against the drug and alcohol clinic on October 3, 2011 for intrusion into private affairs and violating her constitutional rights to privacy as well as fraud, negligent hiring, negligent supervision and infliction of emotional distress.

E! News confirms that a judge has set a trial date for January 9, 2013, but both sides will be speaking to a mediator in the not-so-distant future.

Mueller's reaction to the news?

Her attorney, Allie Weinstein, tells E! News they are "thrilled with the judge's decision," adding, "We obviously look forward to going to trial."

Tonia Arey, the former employee who leaked information about Mueller's admission into the facility in 2010, says in a declaration that she "was never given a manual on employee protocol or expectations" and "never attended any meetings where the importance of patient confidentiality was discussed."

In Mueller's suit, she states that she was assured all information about her time at the recovery center would be kept confidential and that maintaining privacy was why she chose to enter recovery at that location.
