Bobby Brown's latest prerogative? Fight his DUI charges in court.

After getting popped for allegedly driving under the influence on Monday, the troubled New Jack Swinger is now speaking out in his own defense claiming cops got it wrong.

"Everyone is innocent until proven guilty and Mr. Brown was not driving erratically. He was speaking on his cell phone. Mr. Brown has not been convicted of anything associated with this incident," Brown's attorney, Tiffany Feder, tells E! News.

The R&B singer was pulled over by California Highway Patrol who purportedly noticed him talking on his cell phone, and after approaching him, officers suspected he had been drinking. He was subsequently taken into custody after flunking a field sobriety test and booked at the Van Nuys County Jail.

"Mr. Brown is taking this matter seriously and an investigation is under way. The legal process shall run its course," added the legal eagle.

Brown, of course, has been in the news following the death of his ex-wife, Whitney Houston. He's also no stranger to the law, having been convicted for drunken driving once before, arrested for battery in 2003 and jailed for a parole violation in 2004.
