Gosselins Divorcing by the New Year? Try the Weekend

Despite claims by Team Jon saying the split wouldn't be finalized until 2010, Kate's lawyer tells E! News the judge could sign off within the day

The Pennsylvania courts are about to give Jon and Kate Gosselin the greatest gift of all: singlehood.

Despite claims made just yesterday by Jon's lawyer that the soonest we'd see a Gosselin divorce was after the New Year, Kate's attorney confirms to E! News that Christmas is coming early for the estranged reality duo, with a judge expected to sign off on their split within 24 hours.

"We're expecting it either today or tomorrow," says attorney Mark Momjian. "We had a proceeding this morning and Mr. Gosselin was present without his lawyer. The law clerk said the decree would be entered today or tomorrow and literally, I'm waiting for it. It could be any minute."

Who said there's no such thing as a Christmas miracle?

And what about yesterday's claims by Jon's attorney, Mark Heller?

We're not sure if he was being intentionally misleading or unknowingly misinformed (this is talk-first, think-second Team Jon we're talking about, after all), but Kate's crew couldn't resist sounding off.

"I don't know what Mr. Heller is talking about—he's mistaken," says Momjian of his rival counsel. "The arbitration award has been entered, and it's final and it's binding. We're ready to make a statement as soon as we hear the decree has been signed."

But not a moment before.

"It is an important transition for Kate, and her children and Jon's children, and we want to wait until it is finally done," he adds.

As for Jon, he'll have to make another kind of transition—one that involves disarming himself.

Earlier today, a judge ordered Jon to cease bringing firearms onto the very-soon-to-be former couple's Wernersville, Pa., property after photos surfaced of him taking shot practice in their backyard.

Jonny's got a gun? Not around his kids, he doesn't.
