Medical Board Wants Anna Nicole Docs Dinged

Doctors accused of supplying Anna Nicole with prescription drugs fighting to stay in business

If the Medical Board of California has its say, Anna Nicole Smith's personal physician and psychiatrist are going to have to find some other way to make a living.

The regulatory body has asked a judge to prohibit Drs. Sandeep Kapoor and Khristine Eroshevich from temporarily practicing medicine as a condition of their bail as they await trial for conspiring to furnish Smith's drugs.

Candace Cohen, a spokeswoman for the medical board, said the petition was filed on Nov. 20, but she declined further comment, noting the document was not public record.

But the doctors aren't going down without a fight.

Meanwhile, Kapoor's attorney, Ellyn Garofalo, says the board has no evidence whatsoever that her client posed any kind of risk.

"The medical board has not and cannot show that his continued practice of medicine poses any public threat. That's the standard to divest the doctor of his medical license," she tells E! News.

If anything, she suggested in court documents that board members undermined their own accusations by waiting so long to lodge them.

"If the medical board had any concern, they had been the investigative agency since March 2007 and this is not news to them," Garofalo says. "They have done nothing and allowed him to practice two years and nine months [after Anna died and] he was charged and I think this is just a misplaced strategic motion that will be unsuccessful."

The lawyer argues in a court filing that both docs need to be able to write prescriptions as they have numerous elderly patients, including a handful in hospice dying of cancer, who rely on the medicines they provide.

The two doctors, along with alleged coconspirator Howard K. Stern, are due back in court on Friday.
