Barron Hilton was busted for driving under the influence. But get this: Even if he were sober, he shouldn't have been allowed to get behind the wheel, a source tells me.

Why?

“He does not have a valid driver’s license in California—or anywhere else that I’m aware of,” says the source, who is close to the 18-year-old hotel heir.

A younger brother of Paris and Nicky, Barron was arrested earlier today on suspicion of driving under the influence and carrying a fake driver’s license. And as I was the first to report, mom Kathy and dad Rick have decided not to bail him out as quickly as he probably expected.

"His parents do not have any plans to bail him out or pick him up," the source says. "So, unless someone else bails him out, he has to wait for Own Recognizance—and a ride."

(Update: How true that it is. I just learned he called in a bail bondsman and walked out of jail around 5:50 p.m.)

His bail was upped from $5,000 to $20,000 because of the fake-license charge.

“He’s probably better off in jail than what he’s going to get once he gets home,” the source says. “To say that his parents are upset is an understatement. They’re very surprised but equally furious.”

My source says family and friends are shocked by Barron’s run-in with the law.

“He is a very sweet boy with a gentle soul,” the source says. “He’s superquiet and very reserved.”

About a year ago or so, I’m told, Barron moved back to Los Angeles from an East Coast boarding school. “He missed his family and moved back to L.A. so they could all be together,” the source says. “He’s been prepping for college in the fall.”

As for the Mercedes he was driving, my source says the family believes it belongs to the family of the unidentified female passenger who was in the car at the time of the arrest. Kathy's and Rick's cars are all accounted for today, the source says.

“He snuck out after his parents went to sleep last night,” the source says.
