Sean Stewart on the Defensive Again

Rod's son sued for assault and battery by a man who claims Sean Stewart was part of a group that beat him up outside a Hollywood club in January 2006

Sean Stewart has got to get himself a better entourage.

The Sons of Hollywood star was sued for assault and battery Tuesday by a man who alleges Stewart was among a group a people who attacked him in January 2006.

This is not to be confused with the felony assault charges Stewart is facing for allegedly lobbing a brick at a couple in the Hollywood Hills in April. That duo has also filed a civil suit against the 26-year-old.

In the lawsuit filed yesterday in Los Angeles Superior Court, Daniel Refoua charges that Stewart and his unnamed companions "attacked, assaulted, battered, punched, beat, hit, struck, tortured and imprisoned" him by "illegally and forcefully restraining, choking and beating" him on Jan. 5, 2006 outside of the Hollywood nightclub LAX.

Refoua claims that he suffered severe personal injuries and extreme mental shock from the alleged smackdown. There's no mention in the suit of how or whether Refoua knew the defendants or what may have provoked the incident.

The plaintiff is seeking unspecified general, special and punitive damages for assault, battery, false imprisonment, negligence and intentional infliction of emotional distress.

That makes two assault-and-battery suits for Stewart, who was also sued in May by Tobalus and Ericka Stein, the couple he allegedly roughed up after he and his posse were denied entry into a house party on Miller Dr. in West Hollywood.

According to their suit, the Steins claim that Stewart and his friends started "swinging their arms at, punching, throwing bricks and other items" at them, as well as started wailing on each other and the Steins' truck as they drove by, the unprovoked attack causing the couple "shock, horror, fright, worry, grief, shame, embarrassment, anger and chagrin."

Meanwhile, Rod and Alana Stewart's son pleaded not guilty last month to two felony counts of assault with a deadly weapon and one count each of throwing substances at a vehicle and vandalism with damage in excess of $400. He was arrested on June 12 and released on $60,000 bail, which will keep the young man free so long as he stays away from the Steins, according to Los Angeles Superior Court Commissioner Catherine J. Pratt.

Stewart is due back in court on the criminal charges Aug. 6.

The reality-TV star's attorney has not yet commented on the new suit, but he said in June that the Steins have "a financial motive" for going after his client and that his own investigation into the incident has "revealed that any crimes which may have been committed that night, were in fact committed by the person who claims to be the victim."
