Wesley Snipes continues to beat the heat in Florida.

A federal judge issued an emergency stay Monday that will allow the actor's surrender date—Sept. 2—to come and go.

More than two years after being convicted of misdemeanor tax evasion, Snipes was finally supposed to start serving his three-year prison sentence. But there's ever so much more paperwork to be filed.

An appellate court upheld Snipes' conviction and sentence last month, but on Aug. 5, U.S. District Court Judge William Terrell Hodges gave Snipes' camp 20 days to file a motion for a new trial, after which prosecutors would have 20 days to respond.

Hodges also said at the time that he would refrain from ruling on any motions from either side, such as one to revoke Snipes' bond (prosecution) and another for permission to question trial jurors about any preexisting bias (defense).

Today, the U.S. District Court for the Middle District of Florida ruled that all of the pending motions preempted the prison sentence for now and no new surrender date was set.

Snipes may be able to take part in the indie action flick Havana Heat, set to start filming in November, after all.
