David Byrne Drives Florida Governor to Court Over "Road to Nowhere"

This time it's the former Talking Heads frontman who doesn't want his music being used in a GOP attack ad

David Byrne doesn't want to be confused with just any old talking head.

The Scottish-born rocker sued Florida Gov. Charlie Crist Monday for using the Talking Heads tune "Road to Nowhere" in an attack ad on his likely opponent in the upcoming U.S. Senate race, Republican candidate Marco Rubio.

Crist, a longtime member of the GOP, is running for the open Senate seat as an Independent, though he's still a registered Republican.

But any affiliation is too close for comfort for Byrne, a British citizen but longtime resident of the U.S. who doesn't mix politics with his public life.

To think that Crist went ahead and used his song without permission, after the Republican National Committee vowed not to do any such thing after Jackson Browne sued John McCain for the same reason, is "extraordinary," states the federal lawsuit filed Monday in Tampa.

Byrne claims that he has suffered at least $1 million in damages from "Road to Nowhere" showing up in the anti-Rubio ad, a figure arrived at based on the amount he's turned down from other politicians who wanted to use the suggestively titled song, lawyer Edward Livingston said.

Crist's office hasn't yet commented on the suit, but Livingston said that the governor's people did take the ad down when asked.
