Emergency Surgery Keeps Brooke and Charlie Out of Court

Brooke Mueller's medical emergency forces postponement of first hearing since Sheen's domestic violence arrest

As if the prospect of going to court wasn't enough of a pain.

Tomorrow's hearing in Colorado on whether to extend Brooke Mueller's order of protection against hubby Charlie Sheen has been postponed until Friday because Mueller had to undergo emergency oral surgery.

Not that Sheen's recuperating spouse is in the mood to make the trip at all.

"Ms. Mueller's attorneys filed a motion this morning requesting she be allowed to appear telephonically because she had a medical emergency," Aspen Police spokewoman Stephanie Dasaro tells E! News.

"She had emergency surgery in regards to an oral infection. The judge denied the motion; however [he] did grant a continuance until Friday at 10 a.m. Mueller is required to be at the hearing on Friday."

This will be the first required court appearance for the couple since Sheen was arrested early Christmas Day for allegedly assaulting and threatening Mueller with a knife during a fight at their rented Aspen vacation home.

Amid conflicting reports of whether they're still in it (i.e., their marriage) for the long haul, Mueller's attorney told E! News last week that his client had returned to the home in L.A. that she shared with Sheen and their twin sons, while the Two and a Half Men star is staying with a friend.

Sheen's docket also includes a date with a judge on Feb. 8, by which time Pitkin County D.A.'s Office will have determined whether to press charges or not against the actor.
