Malibu woman seeks restraining order against Daniel Baldwin claiming he made threats after niece was fired

He's a celebrity...and she wants him out of here!

On the business end of a restraining order, that Baldwin brother known as Daniel is smacking down allegations that he harassed and threatened a Malibu woman and her family after she canned his niece as their nanny.

Helen Smith says that after she relieved 28-year-old Jennifer Keurhler of duty last month, the 48-year-old actor phoned her husband, Greg, and left a "hostile message," per court papers obtained by RadarOnline. Baldwin, most recently seen getting voted out of the jungle on I'm a Celebrity...Get Me Out of Here!, allegedly sent two text messages, prompting Smith to go to court.

"I know that Daniel Baldwin had had numerous issues with drugs and [I] was concerned for the safety of my children and family," Smith says in the court docs.

And you know that didn't sit well with the former Homicide cop...

In an exclusive interview with E! News, Baldwin goes on the offensive, calling the allegations bogus, defending his sobriety and calling Smith out for cheating Keurhler (who's also his goddaughter) out of her rightful pay.

"I've been sober for years now," Baldwin says before explaining his side of the story.

"[Smith] threatened Jennifer that she would never work in Malibu again, so I texted back, 'Please don't threaten my niece.' Either she's delusional, can't remember what's going on, or she's psychotic."

When the couple welshed on the deal, he says, he decided to look out for his relative's interests as the only kin Keurhler has in the area.

"Jennifer was put in a really bad predicament...so I called. Alec also called once [Editor's note: We hope that went better than this], and Greg, her husband, never returned the calls," he says.

Baldwin says he never threatened but simply spelled out the consequences of the family's failure to pay Keurhler.

"I wish them the best," he continues, adding. "I've never had a restraining order filed against me in my entire life."

A judge has yet to rule on the restraining order, which seeks to keep Baldwin at least 300 yards from the Smith family.

In the meantime, Baldwin's working on expanding his own brood. He and his wife are expecting the arrival of their second baby girl this Thursday.
