Rob Lowe: Ready to Spank Nanny in Court

Judge sets November trial date for showdown between actor and one of his former nannies

Nannygate's got a court date.

With Rob Lowe vowing not to settle the case, a Los Angeles judge today set Nov. 16 as the start of the actor's trial against former nanny Laura Boyce.

“The judge asked about settlement and whether we would want to go into a mediation,” Lowe lawyer Larry Stein tells E! News of this morning's hearing. “We indicated that we did not.”

Translation: It is on like Donkey Kong!

Lowe and his wife filed a breach-of-contract suit against Boyce last year for violating the family’s confidentiality agreement.

On April 7, Superior Court Judge Maureen Duffy-Lewis rejected Boyce's attempt to have the suit thrown out on grounds that the confidentiality agreement violated her freedom of speech.

“Obviously we’re thrilled with the ruling we got on the confidentiality agreement,” says Stein.

Boyce, meanwhile, has her own legal action against the Lowes for sexual harassment, wrongful termination and labor code violations. Her attorney, Gloria Allred, says, “Boyce is still able to pursue and is pursuing her lawsuit."

The Lowes and another ex-nanny, Jessica Gibson, have swapped lawsuits in a separate fight over similar issues.
