A DUI rap doesn't appear to be stopping Ryan Rottman from getting behind the wheel.

Per RumorFix, the Nickelodeon star was spotted driving in Los Angeles on Thursday—a little less than a month after his DUI bust, prompting the site to speculate that he may have violated a judge's order suspending his license.

So could he be driving himself to jail?

Not necessarily.

According to a spokesman for the Los Angeles Police Department, just because Rottman got a DUI doesn't mean he is not allowed to drive.

"Typical with a DUI, they have a temporary license issued to them," Officer Tom Martin tells E! News. "They get a temporary licesne, then they have a DMV hearing within 30 days or so and the DMV decides what to do with their license."

Typically, defendants will have two hearings: one with the DMV for the license and one with the court for the DUI.

"We seize their license," adds Martin. "They get a temporary until a hearing with the DMV."

Martin, who is not directly involved in the Rottman case, said this is standard operating procedures regarding DUIs.

The actor's arraignment had been slated for today, but was continued to Aug. 25. His rep could not be reached for comment.

Rottman got his start with a small part in 2008's The House Bunny before starring in Nick's now-canceled Gigantic, opposite Grace Gummer and Gia Mantegna (better known as the respective daughters of Meryl Streep and Joe Mantegna).
