Brooke Mueller Out of Jail and Back in California With the Kids

Colorado judge lets Charlie Sheen's former missus head back to Los Angeles after her latest bust, but she's required to return to Aspen later this month to face drug and assault charges

Brooke Mueller has returned home.

Three days after getting busted for assault and drug possession at an Aspen, Colo., nightclub, a source confirms to E! News that Charlie Sheen's ex-wife made bail and flew back to Los Angeles on a private jet with twin sons Bob and Max on Monday—after a Pitkin County Judge OK'd a request by her attorneys allowing her to return to Southern California so she can care for the boys there.

Mueller was ordered, however, to return to the posh ski town for her next court appearance scheduled for Dec. 19.

Per the Aspen Daily News, at that point the 34-year-old Mueller is expected to be charged with possession of cocaine with intent to distribute and misdemeanor assault.

The World According to Paris costar got into this latest mess Friday night, when Aspen's Finest arrested her just after midnight at the popular hot spot Escobar after another woman claimed Mueller punched her on the dance floor of another nightclub called Belly Up. Upon taking her into custody, officers reportedly found the cocaine, between 4-5 grams' worth.

She was booked into the local jail and, after Aspen D.A. Arnold Mordkin consented to the extradition waiver and Judge Gail Nichols signed off on it, she was released when a Glenwood bail-bond company posted her $11,000 bond.

As long as Mueller stays out of trouble and turns up for all her court dates, she doesn't run the risk of violating the terms of her bond and can stay in California.

The insider added that Brooke, who's already done numerous stints in rehab, is now talking with people close to her about getting back into a treatment program.

A rep for Sheen was unavailable for comment.

A source tells E!, however, that the erstwhile Warlock has spent the days since his former missus' arrest "doing what he's gotta do" to stabilize the kids, who are now in his care. The source also said Charlie has been working hard on developing his new sitcom, which he'll shoot early next year and that the 46-year-old thesp is sober while Brooke is not.

And while the former couple have been on and off romantically for much of the year, they're currently not seeing each other, notes the insider, although Sheen very much wants her to get help (again).

Of course, that's the pot calling the kettle black, considering Sheen pleaded guilty himself to misdemeanor assault in Aspen after roughing Mueller up on Christmas Day 2009 at their vacation home. That led to the pair's divorce, which was finally approved last May.
