Morena Baccarin's Estranged Husband "Changed His Mind" About Co-Parenting Once Learning of Ben McKenzie

Gotham star is expecting a child with her co-star next year

Morena Baccarin and estranged husband Austin Chick appear to be in a bi-coastal custody battle more than four months after filing for divorce.

In court documents obtained by E! News, both parties first agreed to live in New York City as they share legal custody of their 2-year-old son Julius. In fact, Baccarin agreed to rent an apartment for her ex so they could co-parent.

But according to court papers, Chick "changed his mind" about co-parenting and returned to Los Angeles with their child once he learned that Baccarin "had a new boyfriend." E! News confirmed she was dating her Gotham co-star Ben McKenzie back in September.

From July to September, Baccarin flew back and forth to Los Angeles to visit the child six times. Both parties would later agree that the child should spend time in New York for approximately 18 days per month.

The court, however, later found that for medical (Baccarin is almost four months pregnant) and financial reasons, it is much easier for Chick to travel to New York and visit.

When the court awarded equal parenting time as long as it was all in New York, Chick declined.

Instead, he requested one week per month in New York and one week per month in Los Angeles. The court advised that it would not be in the child's best interest to fly back and forth that often.

Court papers continue to state that both parties "are good parents and bonded with their son." A hearing on child and spousal support is set for Nov. 19.
