For the record, it isn't Brooke Mueller's birthday. And even if it were...

"happy Bday Brooke when you're done sucking off the parking lot at Home Depot why don't ya 'blow' out this candle. c," Charlie Sheen tweeted today, an apparent slam at his ex-wife, who tried and failed to secure a temporary restraining order against him this week after his public disses took a turn for the disturbing in her eyes.

Attached to the tweet was a photo of the remains of a cake with a plastic grenade stuck on top.

A judge denied Mueller's TRO petition yesterday, instead setting a hearing regarding their increasingly heated family drama for Dec. 4 as stories swirl about all sorts of disturbing allegations leveled by Mueller, Sheen and Denise Richards, who has been helping to care for Sheen and Mueller's 4-year-old twin sons, Bob and Max.

Following the judge's ruling, Sheen tweeted, "oh, by the way, nice try this morning Brooke. you are a chubby weirdo who will lose at every turn trying to get between me and my boys. c"

Richards took the 4-year-old twins trick-or-treating on Halloween, along with their half-sisters Sam and Lola and her adopted daughter Eloise—but now TMZ and Radar are reporting that Richards has informed the L.A. County Department of Children and Family Services that the boys are misbehaving in ways that she blames Mueller for and that she no longer wants them to stay with her.

Reps for Sheen, Mueller and Richards have not responded to requests for comment.

According to court documents obtained by E! News, Mueller unsuccessfully petitioned the court to order Sheen to stay at least 100 yards away from her and allow her to record his communications.

She cited her ex telling TMZ that he would "empty his 'war chest'" on her and promising that there would be "a reckoning" among the reasons she wanted protection.

"'There will be a whirlwind. That they will all reap while desperate begging for my forgiveness. You've all been warned,'" her filing quoted Sheen.

The Anger Management star is "out of control and I am very scared for my life," Mueller stated, per the documents.

She further alleges that Sheen has shown a reckless disregard for the Department of Child and Family Services gag order that's supposed to prevent them from smearing each other in public. Mueller says in the filing that she believes Sheen is "a very dangerous man" and "has a lot of connections with people willing to do his dirty business."

Mueller states that she is "petrified" that Sheen will use his connections to "harm or plant drugs on me to jeopardize my standing in the DCFS case." She admits she has struggled with addiction, but says she has completed lengthy in-patient rehabilitations and that she has been substance-free for seven months. She states that Sheen "had hoped that she would relapse in order to continue his long-sought after quest to have all his children under one roof with his former wife."
