Halle's Hubby Looks to Nix Prenup

Eric Benét asks Los Angeles court to rule on the validity of the couple's prenuptial agreement

Eric Benét's better known now as the estranged hubby of Halle Berry than he is for his music career, so it makes sense he wants to profit from being the ex-Mr. Berry.

The 33-year-old R&B crooner filed paperwork in Los Angeles Superior Court this week seeking to challenge the couple's prenup in what seems like a play for pay.

Benét has requested that "the court determine the validity and/or enforceability of the parties' prenuptial agreement and subsequent amendments thereto," according to a copy of his filing published on The Smoking Gun.

So far no hearings have been scheduled on the matter. The court documents do not go into specifics on the prenup or elaborate on how much Benét is seeking from the judge. There has been no immediate comment from either Berry or Benét's camp.

Berry, 35, filed for divorce in April after less than three years together. She blamed irreconcilable differences for the breakup.

In happier times, the picture-perfect twosome swapped vows in January 2001 and made the red carpet rounds. Despite persistent rumors regarding Benét's fidelity, or lack thereof (he eventually copped to being a sex addict), he was by Berry's side when she won her Best Actress Oscar in 2002.

When they announced their split back in October, Berry said that she and Benét needed time apart "to reevaluate our union." The reevaluation didn't take long. Six months later she filed her divorce petition.

The former couple had no children. Benét has a daughter, India, from a previous relationship, and she reportedly remains close to Berry.

Berry, of course, was the bigger breadwinner of the two. Her latest high-profile role will come this summer in Catwoman opposite Benjamin Bratt.

Last week, while promoting the film with an appearance on Oprah Winfrey's daytime chatfest, Berry said she used the comic-book role as therapy.

"I so needed to be Catwoman in that moment," the actress said. "I so needed to make some tough life decisions for myself, and putting on that suit made it a whole lot easier."

Berry also confirmed Benét's wandering ways and confessed that not only did it break her heart, it prompted thoughts of suicide.

"I found out there was woman after woman after woman after woman after woman, and then I realized he had a sickness," she said. "I had an emotional breakdown, and that window, my bay window, looked real good. And I thought I was going to go right through it. I had a little breakdown, took a couple of days off work."

This was Berry's second failed go at marital bliss. She was previously married to former baseball star David Justice, whom she later accused of physically abusing her.

Berry told Winfrey that she now finds it difficult to enter into a trusting relationship and has vowed to never marry again.

If dealing with Benét wasn't bad enough, Berry recently obtained a restraining order against Greg Broussard, a 35-year-old former Navy SEAL, whom she has accused of stalking her and sending her an engagement ring. A hearing is scheduled for Monday.

Lucky for Berry, she has plenty of movies to keep her mind off her personal problems.

She is currently shooting a small-screen adaptation of Zora Neale Hurston's classic novel Their Eyes Were Watching God, produced by Winfrey and Quincy Jones. The telefilm will air on ABC next season.

She's also planning to reteam with Bratt in the drama The Set-Up for director Sydney Lumet and is signed to star in The Guide, a thriller for her Die Another Day helmer Lee Tamahori.

Catwoman, meanwhile, claws its way into theaters on July 23.
