Depending on whom you talk to, it's either a headache for Miguel or the woman he accidentally trampled at the Billboard Music Awards last month.

Or both.

Khyati Shah, the poor fan who ended up on the receiving end of the "Adorn" singer's infamous leg kick, may have sustained a head injury in the mishap, according to her attorney.

Shah's attorney, Vip Bhola, tells TMZ, "Some of the difficulties she's experiencing are cognitive in nature and lead to suspicion of a neurological head injury."

The legal eagle also knocked ceremony organizers for failing to provide proper care, noting that instead of simply giving her an ice pack they should have rushed her to the hospital.

Shortly after Miguel's epic crash-landing, the two appeared in a Billboard interview in which Khyati was seen holding said ice pack to her elbow and even made a funny about the accident, saying she "adorns him," a reference to the hit tune he performed.

Miguel himself tweeted afterwards that he "got caught up in the moment" but expressed relief that "Khyati is okay" (the tweet has since been removed).

But Bhola now says that his client is currently awaiting test results from a neurologist, at which point she'll decide whether or not to sue the singer and possibly the show's producers.

Neither Shah's lawyer nor a rep for Miguel was available for comment. However, Bhola did hint at a lawsuit to E! News last week, revealing that Khyati has been experiencing "difficulties" following the hitmaker's poorly timed jump, video of which has since gone viral.
