Lindsay Lohan has not committed to a rehab facility yet.

Contrary to reports that she's definitely planning to spend her 90-day sentence in New York, attorney Mark Heller exclusively tells E! News that no such plan is in place.

"We haven't figured it out yet," he says. "We are working on that now."

Heller says that New York, where Lohan spends a great deal of time, is a possibility—as is any state with the appropriate facility.

"We are considering whether it will be in New York. We are not sure yet," he reiterates.

Lohan is planning to shoot a guest appearance on pal Charlie Sheen's Anger Management next week. She has until May 2 to show proof to a judge that she's enrolled in a treatment program.

In addition to the stay in so-called locked rehab, the 26-year-old was sentenced to 30 days of community labor and 18 months of psychotherapy and ordered to pay a fine and restitution after pleading no contest to reckless driving and giving false information to a peace officer.
