Real Housewives Catfight! Atlanta's Kandi Burruss Suing Kim Zolciak Over "Tardy for the Party"

Former Xscape singer is suing her ex-costar, saying she and a cowriter helped pen Kim's modestly successful dance track and were never properly compensated

Kandi Burress thinks Kim Zolciak is a real party pooper.

The Real Housewives of Atlanta star—whose legal counsel happens to be costar Phaedra Parks—and songwriter Rodney Richard sued Zolciak this week in federal court, claiming that they cowrote the ex-Housewife's 2009 dance track, "Tardy for the Party," and were never paid their due share of the royalties.

According to the lawsuit filed Tuesday in U.S. District Court in Georgia, "Tardy for the Party" sold upward of 102,000 copies/downloads and the plaintiffs want Zolciak to provide a complete accounting of all "substantial profits and ill-gotten gains" from the single.

Burruss and Richard are seeking an injunction preventing all further sales of the song (iTunes, beware), as well as all the money they feel is owed to them, plus damages for copyright infringement, unauthorized use/unjust enrichment and accounting/constructive trust.

For the moment, Zolciak doesn't appear to be shaking in her stilettos.

"Kandi tried to pull the song down in Dec on iTunes but after I showed documents and proved points song was immediately put back up," she tweeted yesterday.
