Michaele Salahi was married when she took up with Journey guitarist Neal Schon. And estranged hubby Tareq Salahi was quick to remedy that once her "fairy-tale" extramarital romance came to light.

But whether or not Salahi was getting romantic with a married man is now the question!

Schon and second wife Amber Kozan divorced in 2008 after seven years together. He then swapped vows with former Playboy Playmate Ava Fabian in July. (Yes, that's July of this year.)

Their ceremony took place in Paris, though, so...does it count?

According to French law, a couple needs to have either lived in the district where the knot-tying is to take place for 40 days prior to the ceremony, or, live there for 30 days and also have a public notice posted for 10 days announcing the date of the planned marriage and listing any estranged husbands or wives in the picture.

How quaint.

But when asked if Schon and Fabian are legally married, her Beverly Hills-based attorney, Evan Sussman, told E! News, "I can't comment on legal strategy and any of the facts of the case because it is not public knowledge right now."

A rep for Schon has not returned a request for comment, but a source close to the couple says, "They are not legally married and they both know that."

"But in my press release, I said that they are married," Sussman added, referring to the statement he issued earlier today announcing that he had been hired by Fabian.

The estranged duo do not have a prenup, the lawyer told us, and at this time, Fabian is exploring her "legal options." She also has no plans to see Schon, who was spotted checking into a local hotel with Salahi this week, while he's in town.

"She is very hurt," Sussman said. "This is a lot more public than other divorce situations. Generally, you don't find out about your spouse having an affair by the international press."

Er, welcome to Hollywood?
