Jon Gosselin Files for Custody of Plus 8 From "Absentee Mom" Kate

Reality-TV dad keeps his word and files for primary custody of couple's children, citing his ex's commitments on Dancing With the Stars

Apparently, Jon Gosselin is a man of his word.

Well, today anyway.

As his lawyer promised yesterday, the reality-TV dad has asked a Pennsylvania judge for primary custody of his eight kids with Kate GosselinPapers were filed this afternoon.

Jon has also requested that the issue of child support be reevaluated. He says the initial ruling "failed to take into consideration the numerous factors provided for by the law." Such a factor includes Kate allegedly not documenting her claims as to the expenses for the children.

Jon currently is supposed to pay $20,000 per month.

His attorney, Anthony F. List, told E! News that Kate's commitment to Dancing With the Stars was a motivation for some of this litigation.

"She's been an absentee mom, and she's spending very little physical time with the children," he said. "I don't know how, physically, she can spend any time with them because she seems to be taping some show 3,000 miles away."

Kate's attorney, Mark Momjean, has called such claims "patently offensive."

And Kate herself told E! News, "I don't really worry about what other people say because I know it's me who has to feed my kids and take care of them, so that's where my focus is all the time."

This is not funny. Nor was Kate's dismal performance on Monday night. Jimmy Fallon, on the other hand, is hysterical.
