Every rose has its thorn—just ask The Bachelor finalist (and possible winner?) Vienna Girardi. She's still stuck dealing with the dude she dumped before going on TV to be wooed by Jake Pavelka.

Prosecutors in Florida's Seminole County tell E! News that former Girardi flame Brian Lee Smith was busted after he showed up uninvited at her parents house looking for her and then mixed things up with officers.

Here's what went down...

According to the police report, a 911 call came in around 4 a.m. on Oct. 10. When police arrived, they encounted Smith, who, per the report, tried to "get around" a deputy to get to the house.

"Smith willfully entered the premises of [Girardi's] dwelling without invitation from the property owner…then refused to leave the property at Girardi's request," the report states.

Girardi's repeatedly asked the 6-foot, 200-pound Smith to leave but he refused. He then tried "to charge the occupied dwelling and actively made aggressive attempts to get to the front door of the house."

Smith was rung up on misdemeanors for trespassing and resisting an officer. He was allowed to enroll in a six-month diversion program; if  he successfully completes it, the case will be dismissed.

The crazy thing? Even if Smith's after-hours, unwanted house call hadn't been thwarted by cops, Girardi wasn't home at the time to hear what he had to say.

The 23-year-old had already left to shoot The Bachelor, which is down to its final two episodes.
