Halyna Hutchins' Family Files New Lawsuit Against Alec Baldwin for Rust Shooting

After being formally charged with involuntary manslaughter in the fatal shooting of Rust cinematographer Halyna Hutchins, Alec Baldwin faces another lawsuit from her family.

Alec Baldwin has been named in a new lawsuit filed over the accidental fatal shooting of Halyna Hutchins on the set of their film Rust.

Famed attorney Gloria Allred announced at a Feb. 9 press conference that Hutchins' parents, Olga and Anatoly Androsovych, and sister Svetlana, filed the civil suit that day in a Los Angeles court. It comes more than a week after the actor was formally charged with involuntary manslaughter in connection with the cinematographer's' 2021 death.

The lawsuit from her family, who live in Ukraine, alleges battery, negligence, intentional infliction of emotional distress and loss of consortium, and name Baldwin, Rust armorer Hannah Gutierrez-Reed and others involved in the production as defendants.

"To lose my sister at least personally for me was a horrible experience and it is one of the biggest losses of my life," Svetlana said, in Russian, in a video played during the press conference. "And even more devastating is to see the utter suffering of our parents and how their health has sharply declined. It is for this reason that I would like those who are at fault, for somebody to carry that responsibility."

She continued, "I believe to let this go and to leave this unpunished is unallowable."

Allred told reporters that Hutchins' parents and sister "have to try to cope with that loss while living in Ukraine in the midst of [Russian President Vladimir] Putin's war" and that they had hoped to one day move to the United States to be closer to Hutchins, who lived in Los Angeles with her husband Matthew Hutchins and their son Andros, 10.

Both Baldwin and Gutierrez-Reed have denied any wrongdoing in connection with Hutchins' death and reps for them and production company Rust Movie Productions LLC, did not immediately comment on the lawsuit when reached by NBC News.

Hutchins died at age 42 in October 2021 after being hit by a lead projectile fired from a vintage .45 Colt revolver used as a prop, which Baldwin held while rehearsing for Rust on the film's set in New Mexico. In a December 2021 ABC News interview, Baldwin said that while he cocked the gun, "The trigger wasn't pulled. I didn't pull the trigger."

On Jan. 31, Mary Carmack-Altwies, the district attorney for Santa Fe County, N.M., formally charged both Baldwin and Gutierrez-Reed with involuntary manslaughter in connection with Hutchins' death, with her office saying in a statement that the cinematographer "died because of gross negligence and a reckless disregard for safety on the Rust film set."

In a statement issued Jan. 19, following an announcement that criminal charges were coming, the actor's attorney said, "Mr. Baldwin had no reason to believe there was a live bullet in the gun—or anywhere on the movie set. He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win."

Gutierrez-Reed's lawyer told E! News in a statement, also released Jan. 19, that the shooting was "a tragic accident," adding, "She did not commit involuntary manslaughter. These charges are the result of a very flawed investigation, and an inaccurate understanding of the full facts. We intend to bring the full truth to light and believe Hannah will be exonerated of wrongdoing by a jury."

Alec was previously named in a wrongful death lawsuit that Hutchins' husband filed in February 2022—four months after his wife's passing. In October 2022, Matthew said in a statement that the parties reached a settlement and that the case will be dismissed. There was no admission of wrongdoing.

"I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin)," Hutchins' husband added. "All of us believe Halyna's death was a terrible accident."

Matthew also said, "The filming of Rust, which I will now executive produce, will resume with all the original principal players on board in January 2023."

On Jan. 20, a person with knowledge of the project told The New York Times that the movie was still on track to be completed with Baldwin in the lead role and that there would be on-set safety supervisors and the banning of any use of working weapons or any form of live ammunition, including blanks.
