Take it from Chris Klein, who today was formally charged with two misdemeanor counts stemming from the American Pie man's early morning (or was it late night?) DUI bust this month.
The Los Angeles City Attorney's Office slapped Klein with one count of driving under the influence and one count of driving with a blood-alcohol level of 0.08 percent of higher.
Neither charge is much of a surprise, as the California Highway Patrol let slip to E! News shortly after his arrest that Katie Holmes' ex was driving at nearly three times the legal limit.
The 31-year-old voluntarily admitted himself into a minimum 30-day stay at Utah's rehab-to-the-stars Cirque Lodge last week, but he'll have to temporarily bust out before then.
Klein is due in court to be arraigned on the dual charges on July 9.
Unfortunately, the latest arrest marks Klein's second career DUI, as he pleaded guilty back in 2005 to a misdemeanor charge. This time around—barring any plea deals—if Klein is convicted on the new set of charges, he faces a minimum of four days and maximum of one year in county jail.
"There is also a period of probation, fine of $2,000 and with DUI convictions there are usually AA classes that are part of the sentencing," L.A. City Attorney's Office spokesman Frank Mateljan tells E! News.
And according to a new California law put in place at the beginning of 2010, Klein could also be required have an interlock device installed on his vehicle which he would need to blow into to start the engine should he be convicted.
"It all depends on what the judge tells him he needs to do," says a California Highway Patrol spokesman. "If the judge requires him to get that system then he is required to put it on his vehicle and keep it on there for the required amount of time determined by the judge."
