Kirsten Dunst Gets Another Shot at Accused Burglar

It's the most wonderful time of the year—for a court date!

With New York prosecutors deciding that a trespassing conviction isn't good enough, a retrial has been set for Dec. 3 for a man accused of helping to steal wallets, cell phones and a host of luxury items from Kirsten Dunst's hotel room in 2007.

A jury convicted James Jimenez of criminal trespass on Oct. 2 but deadlocked on felony burglary charges that could land him behind bars for up to 15 years.

Prosecutors have not said whether Dunst and her How to Lose Friends and Alienate People costar Simon Pegg, whose iPod, cell phone and camera were also snatched, will be called to testify again.

Jimenez has admitted to being in the actress' suite, but has maintained that he had no idea his alleged partner in crime, Jarrod Beinerman, was planning to rob it. Beinerman copped to attempted burglary last year and is currently serving a four-year prison term.

Maybe Kirsten Dunst didn't quite get her point across.

The man accused of busting into her NYC hotel suite and stealing roughly $15,000 worth of handbags and electronics in 2007 was convicted Friday of criminal trespass, a misdemeanor that could land him in jail for a year.

Meanwhile, the jury deadlocked on the weightier burglary charges, which could have netted James Jimenez, 35, up to 15 years in prison. Another man involved in the incident, Jarrod Beinerman, copped to attempted burglary last year and settled for four years behind bars.

Kirsten Dunst is apparently better at banter onscreen than off.

So it was today as the Spider-Man star took the stand for 30 minutes of rambling, giggling testimony in the burglary trial of a mechanic believed to be the mastermind of a 2007 heist of $15,000-plus worth of goodies from Dunst's hotel room

James Jimenez, 35, is accused of sneaking into the actress's unlocked penthouse suite at the SoHo Grand Hotel while she was in town filming the 2008 comedy How to Lose Friends and Alienate People with Simon Pegg and Megan Fox.

Prosecutors allege Jimenez and Jarrod Beinerman, 34, made off with a $13,000 Balenciaga bag, a $2,500 Marc Jacobs handbag, her wallet, credit cards, iPod, cash, cell phone, two cameras and, yes, even lip balm.

The 27-year-old Dunst told jurors she had been in the suite with Pegg, some crew members and movie mogul Harvey Weinstein watching YouTube clips and eating takeout from Nobu. The two actors then left to shoot their final scenes when the bandits struck...

Kirsten Dunst Ho-Ho-Holds Back Alleged Stalker

Kirsten Dunst got an early Christmas gift.

A Los Angeles judge has granted the Bring It On star a permanent protective order against the man who paid an unannounced, unwanted visit to Dunst's Hollywood home professing a "spiritual connection" with her.

Superior Court Judge Richard E. Rico prohibited Christopher Smith, 25, from coming anywhere near the actress, her personal assistant, her residences and her places of business. The L.A. native is also barred from owning or possessing a gun.

The order was handed down without being contested because Smith never responded to Team Dunst's original petition for a temporary restraining order filed last month. Neither he nor Dunst appeared for today's ruling.

The 26-year-old Spider-Man sidekick initially went to Rico after Smith's Thanksgiving trip to her house, where he allegedly displayed "aggressive" and "harassing" behavior and claimed the two had "some sort of spiritual connection" despite never meeting.

Kirsten Dunst Fends Off Serial Trespasser

Kirsten Dunst has a lot to be thankful for this holiday season—including a brand-new restraining order against an alleged stalker.

The Spider-Man star took the action after one Christopher Smith allegedly showed up unannounced at her Hollywood Hills home, most recently on Nov. 20. While there, she states in court papers, he exhibited "aggressive" and "harassing" behavior, while claiming "he has some sort of spiritual connection" with her even though they have never met.

"Mr. Smith has repeatedly shown up uninvited at my place of residence in Los Angeles, going so far as to ignore police warnings, bypass my personal security measures, trespass on my property, and attempt to gain entry into my home," Dunst says in her declaration.

The guy accused of stealing a bunch of stuff from Kirsten Dunst is paying for it in spades.

Jarrod Beinerman, 33, was sentenced to four and a half years in jail after pleading guilty to attempted burglary in connection with the theft of a $13,000 Balenciaga bag, an iPod and various other goodies from Dunst's suite last year at the Soho Grand Hotel in Manhattan.

Kirsten Dunst is hard at work shooting her next movie, All Good Things, on New York’s Upper West Side.

But she’s decided to focus on something else today—opening up to dispel rumors and tabloid reports that she sought help earlier this year at Cirque Lodge treatment center in Utah due to alcoholism and substance abuse.

“I didn’t go to Cirque Lodge for alcohol abuse or drug abuse,” Dunst tells me exclusively during a lunch break on All Good Things. “I went there for depression.”

The 26-year-old Hollywood veteran makes a point of explaining that while she consulted doctors along with family and friends about treatment, it was ultimately her decision to make.

“It was a good six months before I decided to go away,” Dunst says. “I was struggling, and I had the opportunity to go somewhere and take care of myself. I was fortunate to have the resources to do it. My friends and family thought it was a good idea, too. But I didn't know where to go. My doctor recommended Cirque Lodge.”

Dunst says she’s decided to go public with her depression and treatment because she’s not the only one who finds herself facing the ongoing—and often nasty—speculation in the press and elsewhere.

Kirsten Dunst Brings on Rehab

Kirsten Dunst had to rescue herself this time.

The Spider-Man heroine has checked into rehab to treat deal with an unspecified issue.

"It's sad but true. She's in treatment," a source close to the actress tells E! News. The insider declined to elaborate on the nature of Dunst's treatment or where she was.

One place she's apparently not is the celeb-friendly Cirque Lodge treatment center in Park City, Utah, despite a published report saying she was at the facility.

"Nope, not true," says Gary Fisher, the lodge's director of operations. He added that while the facility prides itself on refusing to comment on the comings and goings of celebrity patients, Dunst is definitively not, and never has been, at the center.

The denial comes on the heels of of a a People report quoting an unnamed friend of the 25-year-old claiming the thesp was "not doing well," "has been crying a lot" and surmising that "the Heath Ledger thing" was likely the impetus behind Dunst's voluntary check-in. 

Star magazine was first to report the thesp was in treatment. Dunst's rep has yet to comment on the reports.

Cirque Lodge is the same facility Lindsay Lohan visited for her most successful rehab stint to date—a two-month stretch last fall during which time the starlet took long nature walks, went whitewater rafting, wrote in her journal and otherwise pieced her life back together.

Mary-Kate Olsen also logged time at the exclusive facility in 2004, and Eva Mendes has reportedly been receiving treatment there recently as well.

While Dunst has usually been one to keep her name out of the more scandalous pages of the magazine aisle, minus the requisite tabloid interest in her love life, some seemingly uncharacteristic behavior at the Sundance Film Festival had people speculating whether something specific was troubling her.

At the time, Dunst's rep issued a statement assuring that her client was fine.

A source close to the Marie Antoinette star told E! Online's Awful Truth, however, that the actress hasn't been feeling right for some time and that an old romantic wound might be part of the problem.

"She’s never really been the same since she broke up with Jake," the source said. "Never."

Dunst and Jake Gyllenhaal haven't been an item since 2004, when they amicably parted ways after nearly two years of dating. Her most recent love connection was made with Razorlight frontman Johnny Borrell, but the two split up last year.

"I don't ever want to date another actor again," Dunst said in Jane magazine's May issue, while she and the British rocker were still a couple.

"This quote is probably going to come back in my face, but I know someone who has a great saying: 'There are no actors, there are only actresses,' " she said. "Sometimes creative people can be very dark and destructive."

But she added, "I'm only saying bad things. I do know a few actors who are good and sweet and adorable."
