Just as John Kerry predicted, his daughter's DUI charge has disappeared. But prosecutors say it's business as usual.

The Los Angeles City Attorney's office confirmed to E! News today that actress-filmmaker Alexandra Forbes Kerry won't be facing a misdemeanor charge following her arrest last week.

"Our prosecutors had an opportunity to review the report that was sent to us and felt there was insufficient evidence to warrant the filing of charges," spokesman Frank Mateljan said, noting that  the 36-year-old registered .06 on a Breathalyzer test—a smidge under California's legal limit of .08.

He also dismissed any speculation of favoritism, saying that prosecutors traditionally decline to move forward with such borderline cases.

After she was pulled over Thursday, her ever diplomatic dad released a statement noting Alexandra was under the limit and expressing his full support for her.

R.Pattz wasn't there, so why did a bunch of screaming fangirls nearly cause a riot at a Long Island mall?

They were waiting for Justin Bieber, of course!

One girl ended up at the hospital and a member of Bieber's entourage was arrested after more than 1,000 young and rowdy fans whipped themselves into a frenzy awaiting the arrival of the the 15-year-old Canadian pop star, who ended up steering clear of the mall altogether because of the melee.

"They are not allowing me to come into the mall. if you dont leave I and my fans will be arrested as the police just told us," Bieber twittered this evening, about an hour after writing, "On my way to Roosevelt Field Mall in Long Island, NY to sign and meet fans!! im pumped. see u there."

Aw.

The filmmaking eldest daughter of former presidential candidate Sen. John Kerry was busted early Thursday for driving under the influence, a spokesman for the Los Angeles Police Department confirms to E! News.

Dad's not gonna be too happy about this.

Let's just say this doesn't look good for the defense.

The surrogate mom who gave birth in July to Sarah Jessica Parker and Matthew Broderick's twin girls took center stage today in her own courtroom drama. Michelle Ross testified in the criminal trial of an Ohio lawman accused of orchestrating a break-in at her home to dig up dirt he could then sell to the tabloids.

Ross said she learned of the alleged scheme by Martins Ferry Police Chief Barry Carpenter from a paparazzo, who had come to town hoping to snag a picture of her while she was pregnant with the Sex and the City star's children.

She said she noticed someone had rifled through her belongings and, per the local WTOV-TV, some items were misplaced, including a plaster cast of her tummy when she was preggers with her own son, not Parker and Broderick's.

Ross, who refused to be videotaped or voice recorded while on the stand, also told the jury that ultrasound pictures and documents with tax information had disappeared.

UPDATE: Andrews' accused stalker was in court Friday, where bail was raised to $100,000. Barrett was released on a bond after agreeing to return to house arrest.

The judge was reportedly planning to set bail at $20,000, but Andrews' attorney, Marshall Grossman, pointed out that Barrett had spent far more than that following his client around the country. She has suffered "severe anxiety" and other "psychological effects" due to Barrett's behavior, he said.

Andrews was on assignment in Nebraska and regrettably could not be in court, Grossman said.

Again Mike Tyson gets to sit back and wait for a ref's decision.

The Los Angeles City Attorney's Office is investigating the former heavyweight champ's Nov. 11 dustup with a photographer at LAX and will determine whether charges should be filed—against either Tyson or the shutterbug who allegedly buzzed around him until he snapped.

Tony Echevarria told police that Tyson assaulted him at the airport when he tried to get a picture, leaving him with a nasty cut on the forehead.

But Tyson's rep maintains that Echevarria followed the ex-boxer, who was fresh off a plane from London with his wife and daughter in tow, from one terminal to another and intentionally provoked him.

Both finger-pointing fellows were taken into custody on suspicion of battery. Tyson was released that night after posting $20,000 bail.

First Hélio Castroneves, now Aaron Carter. Dancing With the Stars has a curse, all right, but it has nothing to do with injuries.

Unless you count the damage done to one's bank account. And permanent record.

Just a week getting booted from the reality-competition show, Carter is on the receiving end of considerably worse news, this time courtesy of the IRS. Turns out, Nick's little bro owes Uncle Sam more than $1 million in back taxes.

Just think of all the Kleenex that could buy.

As it is, according to court documents filed last week, Carter's tax delinquency dates back to 2003, a clearly banner time for the cry baby pop star, as he's indebted to the federal government a whopping $965,284.97 from that year alone.

An additional $45,350.11 is also owed from income earned in 2006, making his debt grand total a hefty $1,010,635.08.

We don't care who you are, that figure's gonna bring on the waterworks.

It's always the quiet ones you've got to watch out for. Brian Johnson, we're looking at you.

A temporary restraining order has been issued against erstwhile Breakfast Clubber Anthony Michael Hall by his ex-girlfriend, who claims, according to the New York Post, that the actor attempted to kick down her apartment door last week.

Diana Falzone, a radio personality and (irony alert!) relationship expert whose last column was titled "How Not to Date a Loser," filed a police complaint a week ago. She had dated the actor for roughly a year, but the duo is no longer together.

She reportedly said that after Hall's failed attempts to kick down her door, she let him in her apartment, only to have him bash her head against the wall.

The 41-year-old former Brat Packer allegedly stalked her prior to the attack, and the order bars him from "assault, stalking, harassment, menacing, reckless endangerment...intimidation," among other behavior no-nos.

While Hall himself, who suffers from a mild case of bipolar disorder, has yet to speak out on the incident, his spokesman told the Post that "all of the allegations are erroneous and will be addressed accordingly."

Still, it could have been worse. He could have had a flare gun.

Cindy Crawford can breathe a little easier.

Edis Kayalar, the 26-year-old man accused of trying to extort $100,000 from the supermodel and husband Rande Gerber, turned himself in late Monday to police in Stuttgart, Germany.

According to authorities there, Kayalar surrendered in connection with the federal criminal complaint lodged by the couple last week. They claim Kayalar threatened to release a "prank" photo their nanny took of their then 7-year-old daughter tied to a chair and gagged during a game of cops and robbers. He demanded Gerber and Crawford hand over the money or he would make the seemingly inappropriate picture public.

The FBI subsequently launched a criminal investigation and a warrant was issued in Kayalar's home country. He had been deported from the U.S. a month ago on an unrelated matter—Kayalar has a violent history with his ex-wife and former girlfriend that include allegations of rape and beatings.

He was booked on one count of extortion in the Crawford case and faces up to two years in prison if convicted. He's due to appear before a judge sometime today.

Elisabeth Hasselbeck may be a lot of things, but a rip-off artiste isn't one of them.

A plagiarism lawsuit brought against The View's token conservative was dismissed last week after her accuser's attorney declined to pursue the case.

The woman behind the initial court action was Susan Hassett, a self-published author who claims that Hasselbeck's recently released best-seller, The G-Free Diet: A Gluten-Free Survival Guide, lifted significant passages from Hassett's own book on celiac disease.

U.S. District Court Judge Joseph Tauro dismissed the case last Thursday after Hassett's attorney failed to turn in paperwork related to the case in a timely enough manner. He later said that while portions of Hassett's dietary prose were definitely lifted for Hasselbeck's book, the passages weren't significant enough to warrant damages.

Which is apparently all the lawyer needed to hear to get packing.

First The Bachelor breakup and now this...Shayne Lamas just can't seem to catch a break.  

E! News has learned exclusively that the 24-year-old Leave it to Lamas reality star was taken into custody on suspicion of DUI charges just after 1 a.m. Saturday in Venice, Calif. 

"Early Saturday morning, after consuming one drink, I willingly drove through a mandatory check point on my way home with complete confidence of passing," Lamas tells E! News. "However, the breathalyzer indicated that I was over the legal limit of blood alcohol content and was arrested onsite.

"I take full responsibility for my lack of judgment. I have always strived to be a role model for my friends, family and fans and have never nor will ever condone drinking and driving. I apologize for all those I have disappointed, including myself."

The reality star was released later that morning. She's due in court Dec. 9 for the misdemeanor charge.

Stephanie Pratt might not be the brightest bulb, but she could be pulling out a novel defense in her drunken-driving case:

Don't blame the booze, blame the shoes.

With The Hills star MIA from court today, it was up to her lawyer to enter a not-guilty plea on her behalf to a misdemeanor DUI count stemming from her arrest last month.

Pratt, 23, faces up to six months in the clink and a maximum $1,000 fine if convicted. Attorney Jon Bryant Artz told the judge she is willing to serve a 30-day stint in live-in rehab, to avoid driving until she gets a valid license and to refrain from drinking to remain free on her own recognizance.

Outside court, Artz told E! News that Pratt was really pulled over for her tinted windows and, "There's no impaired driving or driving that indicates she was under the influence."

He also implied the reason Pratt may have biffed a field sobriety test was because she was having a hard time negotiating the course in her 4-inch-heeled boots.
