Peter Berg is out of the line of fire.

A negligence lawsuit filed against the actor-director over a fatal accident that occurred in 2006 on the set of Berg's terrorist thriller The Kingdom has been dismissed, according to court documents filed last week.

The parents of Nicholas Papac, an assistant propmaster who died from injuries he suffered when a small utility vehicle he was riding in collided with a Cadillac Escalade carrying Berg and other crewmembers, sued the director and L.A. production company 44 Films in August for unspecified damages.

While records indicate that the plaintiffs moved for a dismissal last week, no further explanation or settlement information was immediately available.

The Papacs had been asking for a payout to cover their son's funeral, medical expenses and lost earnings.
