Sean Stewart's Brick-Tossing Charges Tossed

Some guys have all the luck, especially if they happen to be Rod Stewart's kid.

A Los Angeles County Superior Court judge has tossed four felony charges against Sean Stewart stemming from an April 2007 incident in which the celebuspawn was accused of hurling bricks at a couple outside a Hollywood party.

"He's endured a year of terrible publicity," says Stewart's attorney, Dana Cole, "so he's now very relieved."

A spokeswoman for the Los Angeles County District Attorney's Office declined to comment.

The Sons of Hollywood star was charged last June with two counts of assault with a deadly weapon and one count each of throwing a substance at a vehicle and vandalism with over $400 damage.

Stewart's purported targets, Tobalus and Ericka Stein, filed an assault and battery civil suit against him last May, claiming Stewart and his posse unleashed an unprovoked assault on their vehicle as they drove by the party at approximately 4 a.m.

Per their complaint, Stewart and pals began "swinging their arms at, punching, throwing bricks and other items at them and striking the bodies of plaintiffs as well as striking the [truck]."

Stewart pleaded not guilty to the criminal charges and was ordered to stand trial. But prosecutor Bradley Lieberman indicated he was "unable to proceed" with the case today, so the judge had no choice but to dismiss it. Cole chalked the whole thing up to a case of mistaken identity.

Although Stewart's out of the woods in the criminal case, the Steins' civil suit is still pending.
