Britney: You Snooze, You Lose?

Who would have guessed that in her new single, "Gimme More," Britney Spears is actually talking about sleep?

The besieged pop star reportedly snoozed through two court-ordered drug tests before a family court commissioner turned custody of her two children over to ex-husband Kevin Federline on Monday.

Sources close to the proceedings told the Los Angeles Times that Spears' assistant twice  informed the testing lab that her boss was asleep and then on another occasion told the technicians that Spears would be unavailable to take a test at home.

Twice-weekly random drug testing was one of the many provisions handed down Sept. 17 that would have allowed Spears to retain joint custody of two-year-old Sean Preston and year-old Jayden James after Federline petitioned for primary physical custody.

But L.A. Superior Court Commissioner Scott M. Gordon ruled Monday that Spears was not "in substantial compliance" with last month's order, citing her lack of a valid California driver's license and concluding that a missed drug test was, as far as the court was concerned, a failed drug test. Spears took care of the license confusion on Tuesday, stopping by the Van Nuys Department of Motor Vehicles to be fingerprinted and get her picture taken, and Wednesday she was granted supervised visits every other day with her sons.

The court monitor will report back to Gordon and, if Spears' behavior isn't up to snuff, her privileges could be stripped away at any time.

The "Sometimes I Run" singer, who did not face off against Federline in person yesterday, was ordered to appear at the next scheduled hearing on Oct. 26, as well as complete at least three individual counseling sessions.

Spears' attorney, Sorrell Trope, argued on his client's behalf that she had followed through with most of Gordon's directives, which also included refraining from corporal punishment and badmouthing Federline in front of the kids, meeting with a parenting coach and abstaining from alcohol and nonprescription drugs for at least 12 hours before coming into contact with the children, but Gordon refused to withdraw his previous custody order.

All of Gordon's orders from Sept. 17, including the drug testing, are still in effect. 

Also chiming in on Spears' caretaking skills Thursday was PETA president Ingrid Newkirk, who penned a letter to Kevin Federline persuading him to petition the court for custody of his ex-wife's dogs.

"As a father, your main concern is the comfort and stability of your children," reads the letter obtained by E! News. "London [Spears' Yorkshire terrier] and the other animals whom the boys consider to be a part of the family have provided that comfort and stability. The companionship of beloved companion animals can make a world of difference for the boys during this difficult time, and being separated from the animal friends whom they share a bond with is undoubtedly traumatic for them."

Another thing that Spears has been getting plenty of in recent weeks, in addition to sleep, apparently, is advice. From the ladies of The View to über-parent Dr. Phil McGraw, everyone has an opinion as to what Brit's next move should be.

"I would be willing to sit down with her," McGraw told Ryan Seacrest Thursday on his KIIS-FM morning show. "I'd much prefer to it off air, just the two of us in a room. No agents, no handlers, no cameras.

"This is a girl who can turn this around, but she has to have someone look her in the eye and tell her the truth. There's kids here. The kids are the ones that pick up the tab here."

Unwilling to say whether Spears really does have a substance abuse problem, McGraw, who said that he's contacted her reps, said that what she does have is an addiction to the media.

"I know there's girls whose people call the paparazzi and let them know where they're going to be," said the man who knows "exactly what she needs to do."

"I don't know if that's what Britney does. What I know is this has decompressed. All the air has gone out of her career. All you're picking up is the negatives. I think this has gotten really dysfunctional and really toxic."

In the meantime, while inquiring flashbulbs have certainly been eager to chronicle a possible Spears meltdown, it's sometimes easy to miss that she's also in the middle of a comeback.

Jive Records is heavily touting Spears' new album, slated to drop Nov. 13, and is trying to distance Spears, the tabloid personality, from Spears, the multiplatinum-selling star.

"As Britney’s label, it’s not our place to comment on her personal issues, but we do care about her and support her," Jive spokesman Allan Mayer said in a statement to E! News. "There’s no question that when performers attain the level of celebrity that Britney has, they tend to be treated by the press and public as if they were cartoon or soap-opera characters, and we forget that they’re actually human beings.

"People say that’s the trade-off you make for success in the entertainment industry—that if you want to make it big, you have to surrender your privacy or the ability to lead a normal life. But sometimes you make that bargain before you realize what it entails. Britney’s a grown woman who makes her own choices, and we respect that. But she faces challenges that most of us can’t really imagine."

(Although, we've all hit the snooze button a few too many times.)

The video for "Gimme More," Spears' first music video in more than two years, officially premieres Monday during TRL on MTV, the old stomping grounds of pop princesses like Spears, Christina Aguilera and Jessica Simpson, all of whom rose to fame in the late 1990s.

During filming this past summer, Spears was spotted in head-to-toe black—except for where her thighs, cleavage, midriff and arms are. Already in heavy rotation on YouTube, the Jake Sarfaty-directed video features the 25-year-old, as a blonde, interacting with a brunette stripper alter ego.

She busts a move both alone and with a handful of female backup dancers.
