Vivica's Sobering Summer
It's going to be a hot, dry August for Vivica A. Fox.
A Los Angeles judge has ordered the actress to abstain from drinking alcohol until she is arraigned on DUI charges on Sept. 5, a Los Angeles City Attorney's Office spokesperson confirmed to E! Online. The arraignment was originally scheduled for Thursday.
Per the court's instructions, Fox "can be around it because of the nature of her work, but she cannot consume or possess it."
If she does imbibe, the judge said, the Independence Day star could be forced to fork over bail money, having previously been released from custody on her own recognizance.
Fox has been charged with two misdemeanor counts of driving under the influence and driving with a blood-alcohol level above the 0.08 percent legal limit stemming from her Mar. 20 arrest, before which she was clocked going 80 miles per hour and drifting in her lane on a Los Angeles freeway, according to the California Highway Patrol.
In addition to "exhibiting signs of alcohol intoxication" and failing field sobriety tests, the CHP's official report also has Fox calling one of the arresting officers a "racist white cop" as she was being taken into custody.
"Fox began to walk away, yelling at my partner, 'Brother, help a sister, are you going to let this racist white cop do this…Well, are you?" read the report, which identifies officers Laubscher and De Alba as the authorities at the scene.
She supposedly continued to speak to the cops in "a condescending manner" as she was booked at the L.A. Police Department's Van Nuys jail after failing a Breathalyzer test. Fox reportedly registered a 0.09, just over the legal limit.
Fox is facing a maximum six-month jail sentence and $1,000 fine if convicted on all charges. The 43-year-old actress most recently starred on the Lifetime series Missing and was a contestant on the third season of Dancing with the Stars.
