Lindsay: I'm Innocent
Lindsay Lohan and her lawyer need to get their stories straight.
Hours after police collared the trouble-prone actress for allegedly driving under the influence and possession of cocaine, followed by a statement from attorney Blair Berk proclaiming Lohan had "relapsed," the Mean Girls star offered a completely different spin.
"Yes. I am innocent...did not do drugs they're not mine," she wrote in an email to Access Hollywood. "I was almost hit by my assistant's mom. I appreciate everyone giving me my privacy."
Despite rumors that she was on her way to the famed Betty Ford Center in Rancho Mirage, California, Lohan is still in Los Angeles, sources say.
While the actress may not be in a happy place right now, after being arrested for the second time in two months on DUI-related charges, she is in a "safe place," according to her mom.
Dina Lohan declined to say where her daughter was but released a statement to The Insider and Entertainment Tonight, saying, "I am sick over this.
"My children, my family, we are like prisoners in our own home because paparazzi [are stalking us] outside [our] home. Lindsay is in a safe place. And we are trying to strategically work out our next step," the Lohan family matriarch said.
"We are doing everything in our power in support of Lindsay and I won't give up—this is my daughter and we love her. We are waiting for the press frenzy to die down and leave her alone. And please respect our privacy."
Lindsay Lohan, 21, checked out of Malibu's celebrity-frequented Promises treatment center on July 13, after an extended 45-day stay. She voluntarily donned a SCRAM ankle bracelet, a device that monitors alcohol consumption by analyzing sweat and vapors that arise through a person's skin.
"Addiction is a terrible and vicious disease," attorney Berk said in a statement Tuesday morning. "Since Lindsay transitioned to outpatient care, she has been monitored on a SCRAM bracelet and tested daily in order to support her sobriety.
"Throughout this period, I have received timely and accurate reports from the testing companies. Unfortunately, late yesterday I was informed that Lindsay had relapsed. The bracelet has now been removed. She is safe, out of custody and presently receiving medical care."
Berk, who reportedly drove Lohan to Promises back in May, lambasted the Beverly Hills Police Department late last month for leaking a preliminary report stating the actress tested positive for cocaine and had a blood-alcohol level nearly twice the legal limit when she was busted over Memorial Day weekend. That case has been handed over to the District Attorney's office, but no charges have yet been filed.
This time around, Lohan was arrested at about 2:15 a.m. Tuesday on suspicion of driving under the influence, driving on a suspended license and possession of cocaine, which was found on her person, according to the Santa Monica Police Department.
Officers were responding to a call made by her personal assistant's mother, whose car Lohan was speeding after in her SUV.
"The mother was afraid. She wasn't quite sure what was going on, so she called the police, because she wanted to make sure everything would be okay," Lt. Alex Padilla said, adding that the SCRAM did not alert them to Lohan's alleged condition.
Though Lohan failed a field sobriety test, she had refused a Breathalyzer test at the scene. One performed at the police station registered Lohan's blood-alcohol level at between 0.12 and 0.13 percent, Padilla said. The state legal limit is 0.08.
She's scheduled to be arraigned Aug. 24, the same day she was supposed to appear in court to answer to DUI and hit-and-run charges stemming from the May 26 car crash that prompted her earlier stay in rehab.
Meanwhile, Lohan had been expected to hit the publicity circuit to promote her latest movie, the thriller I Know Who Killed Me, much of which she shot during her first stint in rehab back in January. Her first stop was supposed to be an appearance Tuesday evening on The Tonight Show with Jay Leno.
"You know, we had Lindsay Lohan booked for our show tonight, but apparently she was already 'booked,' " joshed Leno. "I thought our competition was Letterman and Nightline, but it turns out its Cops and America’s Most Wanted.”
Then a blond-wigged Rob Schneider came out in full drag--complete with ankle bracelet he pretended was filled with alcohol.
"Maybe if Elvis got arrested, he could possibly be alive today," Schneider told E! Online senior editor Marc Malkin after the show. "There are worse things in the world and I hope she gets her act together."
