Lindsay "Relapses," Collared for Cocaine, DUI

Actress arrested in Santa Monica on suspicion of driving under the influence, driving on a suspended license and possession of cocaine

The second time apparently wasn't the charm for Lindsay Lohan.

Just 11 days after completing an extended stint at Promises rehab facility, her second tour of duty in treatment this year, the actress was arrested on suspicion of driving under the influence, driving on a suspended license and possession of cocaine, according to police.

The bust took place at 2:15 a.m. Tuesday in Santa Monica, near the intersection of Pico and Main Street.

"Addiction is a terrible and vicious disease," Lohan's attorney, Blair Berk, said in a statement, adding that the actress is "safe, out of custody and presently receiving medical care."

Sources tell E! Online that Lohan had thrown a birthday party for a friend in nearby Venice before her arrest.

According to  Lieutenant Alex Padilla of the Santa Monica Police Department, officers nabbed Lohan while responding to a call about a verbal argument taking place in the parking lot of the Santa Monica Civic Center, located just one block south of police headquarters. The call was placed at 1:35 a.m. by the mother of Lohan's personal assistant, who had quit her post hours earlier.

Padilla said the woman had been chased by Lohan, who was driving a white SUV.

"Why she was trying to catch her, we don't know," Padilla said, adding that the woman told police she was "afraid" and on her way to the police station to seek help when she detoured into the parking lot.

"She didn't make it here," Padilla said from the station. "She ended up in the parking  lot, and that's when she called the police department on her cell phone, and we responded.

"The mother was afraid. She wasn't quite sure what was going on, so she called the police, because she wanted to make sure everything would be okay."

When police arrived on the scene, they detained both parties. Lohan had two passengers in her SUV, described by Padilla as "friends," but their identities were not revealed, nor were the names of the personal assistant's mother and her trio of passengers.

Police conducted a field sobriety test at the scene, though Lohan refused a Breathalyzer test. The actress eventually submitted to one at the station, where her blood-alcohol level clocked in between 0.12 percent and 0.13 percent, per Padilla, well above the state legal limit of 0.08.

While conducting a prebooking search of the actress, police found "a small amount" of cocaine in one of her pants pockets. Padilla said Lohan was "cooperative" throughout the ordeal.

The actress, who turned 21 earlier this month, posted $25,000 bail and was released just after 6 a.m. According to Berk, the star was not wearing her alcohol-monitoring bracelet at the time of her arrest, despite it being a voluntary fixture above her footwear since checking out of Promises on July 13, but shot down at reports that the device was purely ornamental.

"Since Lindsay transitioned to outpatient care, she has been monitored on a SCRAM bracelet and tested daily in order to support her sobriety. Throughout this period, I have received timely and accurate reports from the testing companies," Berk said in a statement.

"Unfortunately, late yesterday I was informed that Lindsay had relapsed. The bracelet has now been removed," Berk said. She did not elaborate on the kind of medical care Lohan was receiving and whether she would be heading back to rehab.

Lohan's publicist, Leslie Sloane, declined to comment.

At the time of Lohan's release from rehab, Sloane was much more effusive, releasing a statement describing Lohan's "intensive outpatient program," which supposedly included daily AA meetings and daily testing.

"She's doing great," Sloane said. "Lindsay is working hard on her sobriety, and we are all supporting her."

The Georgia Rule star was admitted to the Promises facility on May 28. Her father, Michael Lohan, told E! Online his daughter was being treated for addictions to alcohol and various drugs, including the painkiller OxyContin and cocaine.

She was reportedly driven to rehab by Berk after a lost Memorial Day weekend that included an arrest for drunken driving.

In the wee hours of May 26, the star lost control of her Mercedes SL-65, with the vehicle jumping the curb and smashing into some shrubbery. Lohan was treated at a nearby hospital for minor injuries, and Beverly Hills police determined that alcohol and other "contraband," preliminarily identified as cocaine, had contributed to that incident.

Police waited until last Thursday to formally process the actress. She stopped by the Beverly Hills Police Department to allow herself to be officially booked on charges of driving under the influence and hit-and-run stemming from the smashup. The star was detained for roughly an hour, before being released on $30,000 bail. She's due back in court on Aug. 24.

That case has been handed over the district attorney, but no charges have been filed.

The incident and Lohan's resulting stay in rehab led the actress to cancel a planned 21st birthday party blowout at Pure nightclub in Las Vegas. The actress, however, did make a pit stop at the Sin City hot spot the day after she checked out of Promises, where witnesses claimed she drank only Red Bull and water.

The Promises sojourn was Lohan's second attempt to get sober this year. In January, she checked herself into Los Angeles' posh Wonderland Center for 28 days. While Lohan frequently left the center during the day, mostly to complete filming on the upcoming I Know Who Killed Me, she retreated to the grounds at night. She checked herself out on Feb. 16.

Lohan was also scheduled to be a guest later Tuesday on The Tonight Show with Jay Leno to promote the completed horror flick. A replacement guest has yet to be named.

For the time being, there is one gig Lohan appears to be keeping.

Michael Sands, a consultant on Lohan's upcoming movie, Dare to Love Me, told E! News that Bowline Entertainment, the film's producer, is standing behind the beleaguered actress and that, as of now, she remains insured for her 16-day shoot, scheduled to take place in Romania.

Lohan's arraignment in the Santa Monica case has been set for Aug. 24, ironically the same day she's due in Beverly Hills to answer for her Memorial Day DUI.
