Rx-Related Charges for Girls Guy; Civil Suit Settled

It turns out that jailhouse guards are just as vigilant as those people at the airport who confiscate your too-big bottles of liquids and tiny pairs of scissors.

A day after Joe Francis settled the civil lawsuit brought against him in 2003 by seven girls who classified their underage performances for Girls Gone Wild as exploitation, guards found prescription drugs—a no-no—in his cell at Bay County Jail in Panama City, Florida.

Authorities said that the adult-video entrepreneur has been charged with one count of bribing a public servant, five counts of bringing contraband into a jail cell and three counts of possessing a controlled substance after allegedly trying to pass a guard cash in exchange for a bottle of water, after which the guard discovered three kinds of meds still in Francis' possession.

All of the charges are third-degree felonies and carry a maximum five-year prison sentence.

According to court documents, Francis offered guard Earl Cal $100 Wednesday evening and, when Cal passed, he upped the ante to $500, showing him the bills in the process.

Problem—inmates aren't supposed to be packing cash any more than they're allowed to pack heat.

A search of Francis' cell then turned up 16 pills, including the sleeping aid Lunesta and the anti-anxiety drug lorazepam, under his mattress and under a towel that was lying on a table, per court records.

Francis is holed up in Bay County on a contempt-of-court charge resulting from a profanity-laced outburst he directed at the seven women who were suing him during settlement negotiations on Mar. 21.

U.S. District Judge Richard Smoak ordered Francis to pay the plaintiffs' attorney fees for their time and travel that day. He also ordered Francis to jail, but suspended the ruling after learning that Francis had proposed a settlement. Smoak then reinstated the order after deciding that Francis had only made the offer to avoid jail time.

Which really worked out well, obviously. Francis was picked up Tuesday by U.S. marshals at Panama City Airport, where he was on his way to turn himself in, almost a week after he was supposed to report for jail. He said he was late because he hadn't been able to make either private or commercial flight arrangements before the Easter holiday weekend.

The 34-year-old Santa Monica resident learned of the new charges against him Thursday while in court for a bond hearing on the contempt allegation. After meeting with his attorneys for 30 minutes, the Panama City News Herald reported, Francis waived his right to the hearing and was taken back to jail. Another hearing on the matter is scheduled for Apr. 23.

"I didn't do anything," he told his parents as officers led him from the courtroom. "You know I didn't do anything."

There was no clarification on which "anything" Francis was referring to.

Francis is already out on bail stemming from six state felony charges of featuring underage performers in a sexual capacity in his videos—the very ones that have made him a multimillionaire many times over, prostitution and conspiracy.

The News Herald also reported that local authorities had arrested Scott Barbour, president of Manta Films Inc., one of the companies that makes up Francis' porn-powered empire, for allegedly supplying his colleague with the pills and money. Barbour's due in court Friday.

These latest infractions come a day after Francis a federal grand jury in Reno, Nevada, ruled to indict Francis for income tax evasion for supposedly using offshore bank accounts and other entities to hide more than $15 million of his Girls Gone Wild revenue, as well as allegedly reporting $20 million in bogus expenses on two of his corporate tax returns, according to the IRS and the U.S. Justice Department.

In addition to adding more felony charges to his rapidly growing resume, Francis did manage to put that pesky civil suit behind him Tuesday, with the plaintiffs' lawyer, Larry Selander, confirming that a settlement had been reached.

"What I can tell you is we have told the judge the matter is settled and I believe a dismissal order is on the way," Selander told the News Herald. "I'm very happy that we've been able to help these girls get this episode behind them so they can get on with their lives."

As for the amount, Francis said, "It's a lot. It hurt me a lot and it was hard to get."

Surely echoing the sentiments of many, the 34-year-old Girls creator good-naturedly added, "I think Bay County needs to be done with Joe Francis. I'd like to come back on vacation, sometime. Maybe buy a couple condos. I hear there's plenty available."
