New Judge Hears Anna Nicole Paternity Pleas
The western portion of the Anna Nicole Smith paternity saga has picked up where it left off.
A closed hearing was held Monday in Los Angeles concerning the lawsuit Larry Birkhead filed against Smith earlier this month demanding that she return to California with baby daughter Dannielynn Hope Marshall Stern to undergo DNA and drug tests.
Los Angeles Superior Court Judge Robert Schnider kept the latest proceedings under wraps to protect the little girl's privacy.
A little late, perhaps, but a valiant effort nonetheless. Schnider replaces Commissioner Gretchen Taylor, who removed herself from the case last week.
In his quest to prove himself the father of Smith's baby, born Sept. 7 in the Bahamas, Birkhead is trying to get a court order that would force Smith to hightail it back to the States for testing. Schnider is expected to issue a ruling Nov. 17, according to Birkhead's L.A. attorney, Debra Opri.
Lawyers for Smith and her baby daddy of choice, Howard K. Stern, declined to comment Monday.
Another hearing regarding Smith's challenge to the California court system's jurisdiction over the case has been set for Nov. 8. Birkhead's legal camp has insisted that Dannielynn was conceived in California and since Smith still maintains a residence there, he has the right to pursue the matter in SoCal.
But just in case that doesn't work, Birkhead's new Bahamas-based legal reps filed a civil fraud and conspiracy suit Thursday against Smith and Stern, accusing the couple of wrongfully listing Stern as Dannielynn's father on the child's birth certificate.
"I am the father, and I think this is a crime what these people are doing to me," Birkhead said last week. "I expect to be reunited with my daughter with the help of my attorneys."
Smith's side is maintaining that the reality star is a permanent resident of the Bahamas, despite the fact that an investigation has been opened into who technically owns the waterfront mansion she has been living in.
According to Entertainment Tonight's Mark Steines, who recently interviewed the former Playmate, Smith and Dannielynn "live pretty much like prisoners" in the house.
"There are absolutely no signs of life on the outside," Steines wrote in his ET blog. "I would come to learn that the fear of constant paparazzi keeps Anna and her support team locked up, blinds drawn, and constantly aware that prying eyes are trying to snap photos."
Don't forget the discerning eyes. After seeing snippets of the ET interview, Birkhead is insisting that Dannielynn's hair, which was blonde at birth, he says, is now dark. Which led Opri to suggest that perhaps Smith dyed the child's locks to make her resemble Stern more—an allegation the TrimSpa spokesmodel's lawyers called ridiculous.
