Lou Diamond's Battery Charge
Lou Diamond Phillips may have to stand and deliver a plea.
The 44-year-old actor was charged Thursday with one count of domestic battery stemming from a fight he had in August with his live-in girlfriend, Los Angeles City Attorney's Office spokesman Frank Mateljan told E! Online.
According to prosecutors, in the wee hours of the morning on Aug. 11, the alleged victim locked herself in the couple's bathroom, after their verbal sparring match turned "physical," and called 911. Authorities said that Phillips' girlfriend had scrapes on her knees after being allegedly pushed and dragged through the house. Police arrived at about 2 a.m. and arrested Phillips on suspicion of cohabitant abuse.
Bail was originally set at $50,000 but the La Bamba star was released on his own recognizance after spending several hours in custody. At the time Phillips' rep called the incident a "misunderstanding."
The charge Phillips is facing, a misdemeanor, carries a maximum penalty of one year in jail and a $2,000 fine. Arraignment has been set for Oct. 18.
Phillips has mainly been working the guest-star circuit of late, showing up in Law & Order: SVU as a deranged serial killer who takes a stab at Mariska Hargitay's character and suiting up as an FBI agent on several episodes of Numb3rs. He appeared in the Aquaman pilot in a project for the CW, but the series didn't get a pickup.
The Young Guns player also has the horror film Fingerprints coming up, in which he appears alongside seasoned reality starlet Kristen Cavallari.
On a personal note, Phillips has three children with estranged wife Kelly Preston (not Travolta's wife) and before that was married to Julie Cypher, the birth mommy of Melissa Etheridge's children.
