Shia LaBeouf's License Hearing Parked

Shia LaBeouf can still drive himself to a screening of Eagle Eye this weekend if he wants.

A hearing to determine whether his license should be suspended in connection with his July 27 car crash, originally scheduled for today, was postponed, according to the actor's attorney.

Authorities contend that LaBeouf—who was taken to Cedars-Sinai Medical Center by ambulance immediately after the accident—refused to take a blood-alcohol test afterward, an infraction that merits a minimum one-year suspension, per the Department of Motor Vehicles.

The 22-year-old actor was cited for misdemeanor DUI at the hospital based on observations made by officers at the scene. He was never taken into custody or made to pay bail and the L.A. District Attorney's Office opted yesterday not to press felony charges against him.

There's no word yet on whether the City Attorney's Office is going to try to get LaBeouf on a misdemeanor.

LaBeouf's attorney, Michael Norris, told TMZ.com that he believes he can convince the court that, when the Transformers star was finally asked to take the test, he was asked under dubious circumstances.

"Asking someone to provide a blood or breath test while they're being prepared for surgery on a gurney is a very unusual situation," Norris said.

He also wants to check all video footage the Sheriff's Department has of the accident scene, to make sure that LaBeouf was "legally arrested."
