Arraignment Comes Up Empty for Andy Dick

Andy Dick's defense team was left speechless today.

With his lawyers primed to enter a plea in Riverside, Calif., in the comedian's battery/public intoxication/Xanax-and-pot-possession case, both sides instead found themselves on the receiving end of a schedule change.

Dick's arraignment has been delayed until Oct. 3 "as a result of a miscommunication between defense counsel and prosecutors regarding plea negotiations,” a court public information officer told E! News Tuesday.

"The miscommunication will be cleared up by the next court date," he added, speaking on behalf of the Riverside County District Attorney's Office.

Dick was charged last month with four misdemeanor counts of battery, public intoxication, possession of Xanax without a prescription and possession of marijuana in connection with his July 16 arrest in Murietta, Calif., after he was spotted urinating in a restaurant parking lot and a teenage girl accused him of groping her.

While the former News Radio star was originally booked on suspicion of felony sexual battery, the D.A. ultimately concluded that, based on the "evidence presented and the recommendations of the police agency that made the arrest," the less-punishable charges fit the bill.
