Gary Shirley today asked the courts to drop the order of protection preventing him from being filmed with seeing his ex-girlfriend, Teen Mom star Amber Portwood.
Portwood was released on bail just yesterday following a 24-hour hold in an Indiana jail on domestic battery charges for assaulting Shirley in the presence of their young daughter—while cameras rolled on the MTV reality show.
But in the spirit of Christmas (or an MTV reunion special?), Shirley seems ready to forgive and forget...
A source at the Indiana court overseeing the case tells E! News that the beleaguered baby daddy has been inquiring about getting the no-contact order dropped ASAP.
But it's not entirely up to him.
Following the rules of the court, the source tells E! News, Shirley cannot get the order dropped simply by asking. Either the prosecuting attorney in Portwood's case or Portwood's own attorney has to file a petition for the order to either be modified or dropped altogether.
The judge in the case would then order a hearing, requiring both parties to be present before issuing a decision regarding contact between Shirley and Portwood.
As of now, the dueling duo have to keep away from each other. Portwood's next court date is scheduled for April or May, and until then, they cannot have any contact—directly or indirectly, including telephone or written communication—without an attorney present.
Meanwhile, the county prosecutor clarified that the order only applies to Shirley, not their 2-year-old daughter, Leah, as a sheriff's official mistakenly told E! News yesterday.
Portwood faces two felony counts of domestic battery, one felony count of neglect of a dependent and one misdemeanor count of domestic battery stemming from a brawl between them aired on MTV in the fall.
She is facing up to three years in jail and a $10,000 fine if convicted on all charges. A court hearing is scheduled for Jan. 19.
