Lindsay Lohan Out of Rehab as Court Date Looms

Well, at least Lindsay Lohan gets to spend tonight in her own bed. Or somewhere more comfortable than a rehab dormitory or a jail cell.

With a fateful hearing looming tomorrow morning, the court-bound starlet is due to leave the Betty Ford Center tonight after 24 days.

Lohan checked into the Rancho Mirage, Calif., facility on Sept. 28, four days after narrowly escaping a 30-day stint behind bars while waiting for her date with the judge.

E! News learned earlier this week that Lohan's attorney, Shawn Chapman Holley, tried in vain to set up a meeting with L.A. Superior Court Judge Elden Fox before Friday's probation-violation hearing, during which Fox is expected to either sentence the 23-year-old actress to more jail time or send her back to rehab.

Team Lohan is hoping for option No. 2.

But with Fox not granting Holley any face time, they are now "expecting the worse from him," a source told us.

Lohan spent 14 days in jail earlier this summer for violating probation from her twin DUI arrests in 2007, followed by 23 days at UCLA Medical Center's Resnick Neuropsychatric Hospital.

She found herself on the wrong side of the law again after failing one of her court-ordered drug tests, an offense punishable by another 30 days behind bars if Fox so chooses.

Tomorrow's hearing is scheduled for 8:30 a.m. E! Online will be streaming live from the courthouse.
