Judge Rejects Rip Torn's Probation Request

Actor isn't getting off so easy after breaking into a bank waving a gun

After acting up in a bizarre armed break-in, actor Rip Torn doesn't seems to be getting any star treatment for his boozy misadventure.

A Connecticut judge denied today the Men In Black actor's request for entry into a special probation program to avoid jail time for allegedly breaking into a Salisbury bank after hours drunk and wielding a loaded revolver.

A court clerk tells E! News that Litchfield Superior Court Judge James P. Ginnochio was not swayed by arguments by Torn's attorney, A. Thomas Waterfall, instead siding with state prosecutor Thomas Shepack, who felt the punishment didn't fit the crime.

"Torn was asking for accelerated rehabilitation and that program was denied to him," said the clerk. "The State's Attorney and his own attorney were arguing as to whether he should get this program."

Torn, 79, attended Wednesday's hearing but did not address the judge. He has pleaded not guilty to burglary and weapons charges resulting from the January 30 bust. He remains free on $100,000 bail.

Today's ruling means the Emmy-winning thesp will likely be headed for trial unless his lawyer can cut a plea deal with the state attorney. The next court date is set for Sept. 15.
