Janine Lindemulder's life is heading south.

Not wanting to live 1,400 miles away from her kid, Jesse James' ex-wife is going to move to Texas to be closer to their daughter, Sunny, "once she gets the green light," Lindemulder's attorney, Richard Masson, tells E! News.

The former porn actress was granted joint legal custody of Sunny after proving in family court that she was deserving of a bigger role in Sunny's life. But the victory proved rather moot after James was awarded physical custody and given the go-ahead to take Sunny to Austin at the end of August, in time for the start of the school year.

Lindemulder was originally ambivalent about following Sunny to the Lonestar State, worrying that whatever she had to offer the child wouldn't compare to what her dad or former step-mom (one Sandra Bullock, who coincidentally has a home in Austin) could give her.

But instead of letting those concerns stop her, Lindemulder has asked for more money. She reasons that the extra cash will allow Sunny's lifestyle with her when they're together to be comparable to the one the child shares with her dad.

Masson and James' attorney were in court Monday to discuss Lindemulder's request—a bump from around $3,000 a month to $9,500.

The raise is also important, Masson told the court today, because it will create enough financial security for Lindemulder so that she doesn't have to make a desperate return to her "former line of work."
