Jersey Shore's Sammi Skates on Battery Charges

MTV reality star can rest easier now that her criminal case in Miami is a no-go

The "sweetest bitch you'll ever meet" just got a pretty sweet reprieve.

Jersey Shore guidette Sammi "Sweetheart" Giancola will not face battery charges stemming from a Miami nightclub confrontation in which she allegedly popped someone in the kisser.

Prosecutors opted not to move forward with the case, says Terry Chavez, spokeswoman for the Miami-Dade State Attorney's Office, citing the fact that Giancola has since left the Sunshine State. However, Chavez had a stern warning for the 22-year-old reality star: Don't come back!

"What happens here in Miami-Dade County is, when we investigated the case and spoke to all the witnesses, we did feel there was probable cause to charge to her with misdemeanor battery. However, she's out of jurisdiction," Chavez tells E! News. "If they're out, we're not going to expend the money to go and find them. But if she ever comes back, we'll definitely revisit the matter."

Giancola was accused of getting into a fight with another woman on May 8 at a South Beach hot spot. The alleged victim filed a police report and her complaint was referred to prosecutors.

While they're letting it slide for now, Chavez noted that her office could reopen the case at any time.

"It's not that we haven't treated it with a lot of consideration, but we would do this with anybody, even movie stars," Chavez says.

No word whether the accuser still plans to file a civil suit.

Giancola's attorney, James Leonard Jr., was unavailable for comment. Jersey Shore shot the first part of its season in Miami before moving back to New Jersey. The show's self-proclaimed heartbreaker is currently believed to be in New York.
