UPDATE: Nearly six months after his death, Hopper's widow agreed to payments of $10,000 a month for child and "family support" from his estate. Additionally, the actor's famous art collection will be auctioned off, with 40 percent of the proceeds going into a trust for their 7-year-old daughter, Galen.

Dennis Hopper's wife isn't particularly moved by the idea that he's too sick to answer a few questions.

Despite his illness, he's still an active guy, claim Victoria Hopper's attorneys in new court documents filed in response to the Hopper camp's claim that the cancer-stricken actor is too weak to sit for a deposition in their ongoing divorce proceedings.

If he was healthy enough to make medical-marijuana runs every week, he could have certainly shown up to be deposed, the filing argues.

A declaration from one of Victoria's attorneys, Tara L. Scott, states that their side has been perfectly willing to schedule a deposition at a time that would be most comfortable for Hopper and that they agreed to his attorney's assertion that any meeting should last for more than an hour or two at a time.

Another attorney from Team Victoria, Mirka Royston, added that they agreed to meet at Hopper's home if that would be most convenient for him and to allow his doctor to be present.

That left Victoria herself to swing the big bat: She "fully appreciates the gravity and seriousness of [Hopper's] illness," the papers state.

But according to the media that have been keeping up with Hopper lately, he's been plenty busy.

He is "not bed-ridden and continues to engage in travel plans and various activities," the filing states, including the planning of a retrospective of Hopper's photographs and paintings scheduled to open at Los Angeles' Museum of Contemporary Art in July, his induction to the Hollywood Walk of Fame last month, and a recent trip to New Mexico via private plane with his children and grandkids (albeit with medical staff in tow, as well).

And according to credit card records from January and February, the filing continues, the Easy Rider star had been making weekly visits to medical marijuana dispensaries around L.A., eating out and running errands.

Victoria states that she's not trying to put "extra stress" on Hopper, but thinks its essential to her that her estranged hubby participate in the proceedings to further determine who gets what after they split for good.
